Reilley, MS, GISP <br />SL9 13 <br /> <br />the Division finds that Coors Energy Company has complied with the approved reclamation plan for <br />backfilling, grading and drainage re-establishment for areas 33 and 34. <br /> <br />IV. PROPOSED DECISION <br /> <br />Based on the observations above, the Division proposes to approve Coors Energy Company's request for a <br />Phase I bond release for the Keenesburg Strip Mine. This proposed decision will release the applicant from <br />liability for backfilling, grading, and drainage reestablishment for 19.39 acres. These areas are depicted as <br />Areas 33 (12.46 acres) and Area 34 (6.93 acres) on the map submitted with the SL9 application and <br />illustrated above in Map 1. <br /> <br /> <br /> Photo 3 (below): Revegetation. <br /> The most recent site wide reclamation cost estimate for the <br />Keenesburg Strip Mine was conducted in the fall of 2017 <br />in association with Permit Renewal (RN7). This resulted in <br />a reduction of $79,721.03 in the required bond. In <br />order to estimate the liability eligible for release with the <br />approval of the SL9 application, the site-wide cost <br />estimate with the most recent unit costs (RN7 ) was <br />utilized, and the reclamation tasks associated with the SL9 <br />bond release parcels were calculated. <br /> <br />The current reclamation liability amount set for the site is <br />$1,117,738.82. and comprises the liability to complete <br />backfilling, grading and revegetation of the site. Current <br />surety held is $1,197,459.85. With the approval of SL9, <br />CEC requested release of $64,915.39. However, CEC <br />requested release of bond for topsoiling and seeding, typical <br />tasks associated with a Phase II bond release. As this is a <br />phase I bond release, The Division, according to Rule 3.03, <br />releases bond only for tasks associated with backfilling and <br />grading. The Division finds that the direct cost of reclaiming <br />Areas 33 and 34 to Phase I to be $12,492.00 and, indirect <br />costs to be $3,926.87, for a total release of bond in the amount of $16,418.87. The remaining revised <br />required surety is sufficient to assure completion of the remaining reclamation work at the site if the work <br />had to be performed by the Division, including the cost of reestablishing vegetation on any revegetated <br />areas, should those areas fail. <br />
