Graham, P.O. Box 66, Cripple Creek, CO 80813, <br /> telephone 719-689-2982, and fax 719-689-3172. The Division's records indicate a different <br /> point of contact, address, and telephone and fax numbers for the Applicant/Operator. Please <br /> confirm the information provided is correct or submit a new Page 2 of the application correcting <br /> the correspondence information. <br /> Response: The correction has been made and the replacement page is attached. <br /> Comment 2: The Location Information provided on Page 3 (Question 10) of the application <br /> does not identify the quarter section nor quarter/quarter section for the center of the operation. <br /> Please submit a new Page 3 with the required quarter section and quarter/quarter section <br /> identified. Please do not modify or alter the Board-approved application form. <br /> Response: The electronic application form forces the applicant to make a modification to <br /> provide correct information or to lie by showing an incorrect location. The certification <br /> paragraph 6 on page 7 of the form clearly states that the signee understands " that statements in <br /> the application are being made under penalty of perjury and that false statements made herein are <br /> punishable as a Class 1 misdemeanor pursuant to Section 18-8-503, C.R.S 1984, as amended." <br /> Thus, I am including a replacement page that has been hand checked, and provides an identical <br /> description as that shown on the original. I doubt that your intent is for an applicant to perjure <br /> themselves, but I wonder how many people that you have forced to submit false information in <br /> this section. <br /> Comment 3: The Primary Mine Entrance Location provided on Page 3 (Question-1-1) of the <br /> application does not reflect the correct location of the operation's entrance. It appears the <br /> actual entrance to the operation is located approximately 730 feet west of the provided <br /> coordinates. Please correct the entrance coordinates and submit a new Page 3 of the <br /> application. <br /> Response: I chose a location that lies within the expanded permit area, and since the mine is <br /> open cast, it is quite possible that this location will become part of the mine. Per your <br /> instruction, I have moved the point west approximately 400 feet to be within the current area of <br /> disturbance. Per my calculations, your instruction to move the point 730 feet west, locates it off <br /> of the permit area and just to the west of the City water treatment building at a Longitude 105 <br /> degrees, 10 minutes, 36 seconds. I will be glad to change it to that location if you want but I <br /> think that would be incorrect. <br /> 1 <br />
