Commentl: Page 2 of the application form lists the correspondence information for Bad Boys
of Cripple Creek Mining Co., Inc. as David G. Graham, P.O. Box 66, Cripple Creek, CO 80813,
telephone [phone], and fax [phone]. The Division's records indicate a different
point of contact, address, and telephone and fax numbers for the Applicant/Operator. Please
confirm the information provided is correct or submit a new Page 2 of the application correcting
the correspondence information.
Response: The correction has been made and the replacement page is attached.
Comment 2: The Location Information provided on Page 3 (Question 10) of the application
does not identify the quarter section nor quarter/quarter section for the center of the operation.
Please submit a new Page 3 with the required quarter section and quarter/quarter section
identified. Please do not modify or alter the Board-approved application form.
Response: The electronic application form forces the applicant to make a modification to
provide correct information or to lie by showing an incorrect location. The certification
paragraph 6 on page 7 of the form clearly states that the signee understands " that statements in
the application are being made under penalty of perjury and that false statements made herein are
punishable as a Class 1 misdemeanor pursuant to Section 18-8-503, C.R.S 1984, as amended."
Thus, I am including a replacement page that has been hand checked, and provides an identical
description as that shown on the original. I doubt that your intent is for an applicant to perjure
themselves, but I wonder how many people that you have forced to submit false information in
this section.
Comment 3: The Primary Mine Entrance Location provided on Page 3 (Question-1-1) of the
application does not reflect the correct location of the operation's entrance. It appears the
actual entrance to the operation is located approximately 730 feet west of the provided
coordinates. Please correct the entrance coordinates and submit a new Page 3 of the
application.
Response: I chose a location that lies within the expanded permit area, and since the mine is
open cast, it is quite possible that this location will become part of the mine. Per your
instruction, I have moved the point west approximately 400 feet to be within the current area of
disturbance. Per my calculations, your instruction to move the point 730 feet west, locates it off
of the permit area and just to the west of the City water treatment building at a Longitude 105
degrees, 10 minutes, 36 seconds. I will be glad to change it to that location if you want but I
think that would be incorrect.
