The site visit took place on June 21 and 22, 2018, and was <br />conducted in compliance with section 34-33-118(6) and Regulation 2.07.3(6)(b)(iii). The site <br />visit was attended by representatives of the Division, MCC, WEG and CBD. The previously <br />agreed upon locations were inspected. The Division received a follow-up letter from WEG on <br />June 25, 2018, in which WEG asserted that the PR-15 application should be deemed incomplete. <br />A response letter was sent to WEG on July 6, 2018, outlining the Division’s internal application <br />review process and proposing a date for the requested informal conference. <br /> <br />The Division published a public notice of an informal conference in the Delta County <br />Independent on July 18, 2018, and the requested informal conference took place in Hotchkiss, <br />CO, on August 1, 2018. The informal conference was attended by representatives of WEG, <br />CBD and High Country Conservation Advocates (HCCA), as well as staff of MCC and the <br />Division. A follow-up letter, signed by WEG, SC, HCCA and CBD, was received by the <br />Division on August 20, 2018. <br /> <br />In addition to the above referenced comment letters, the Division received letters from: <br /> <br /> The Colorado Office of Archaeology and Historic Preservation on May 4, 2018, noting <br />that no historic properties had been recorded within the proposed permit area, but that the <br />area had not yet been fully inventoried. <br /> The Bureau of Land Management, Uncompahgre Field Office (BLM) on May 17, 2018, <br />verifying the coal leases, right of surface access and maximum economic recovery of <br />federal coal for the leased lands encompassed in PR-15. <br /> The Office of Surface Mining Reclamation and Enforcement (OSMRE) on June 6, 2018, <br />noting their determination that PR-15 constitutes a mining plan modification, requiring <br />the preparation of a mining plan decision document and approval from the Assistant <br />Secretary of Land and Minerals Management before the proposed mining operations can <br />be conducted on lands containing leased Federal coal. <br /> <br />The Division conducted a preliminary adequacy review of the PR-15 submittal and sent a letter <br />to MCC on June 18, 2108, with ten issues to be addressed. An emailed response to the initial <br />adequacy review was received from MCC on July 6, 2018, with a hard copy of the same material <br />received on July 10, 2018. This submission included revised maps showing an updated mine <br />plan. <br /> <br />The Division received an emailed letter from the BLM on August 7, 2018, updating the findings <br />detailed in the letter of May 17 in the light of the updated mine plan. <br /> <br />During the review process, the Reclamation Cost Estimate for the West Elk Mine was updated to <br />account for new disturbance proposed with PR-15. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
