No comments, written objections, or requests for an informal conference regarding the bond release <br />application were received by the Division. <br />The Division scheduled and conducted a bond release inspection on May 10, 2018. The site inspection <br />was conducted in accordance with Rule 3.03.2(2). Clayton Wein and Janet Binns of the Colorado DRMS, <br />Thomas Medlin of the Office of Surface Mining, Reclamation and Enforcement (OSMRE), Joe Brinton <br />of CAM Mining LLC., and James Stover of J.E. Stover and Associates were present for the inspection. <br />Land owners Josephine Headman, Kathryn Henry, Betty Branch and the Bureau of Land Management <br />were notified of the bond release inspection via certified mail. None of the land owners attended the <br />inspection. <br />II. CRITERIA AND SCHEDULE FOR BOND RELEASE <br />CAM's approved reclamation plan, prepared in accordance with Rule 2.05.4, is contained in Volume 1, <br />Section 3.0 of the PAP. Details of the post -mine topography, backfilling and grading plan, and reclamation <br />schedule are located in Sections 3.1, 3.3, 3.8, respectively, in the PAP. Evaluation and inspection of the <br />Munger Canyon Mine site was based on the specific requirements of the reclamation plan and the <br />functional requirements of the post -mining land use. Reclamation was completed in 2006, 2007 and 2014. <br />PHASE I <br />Rule 3.03.1(2)(a) states, "Up to sixty percent of the applicable bond amount shall be released when the <br />permittee successfully completes backfilling, regrading, and drainage control in accordance with the <br />approved reclamation plan." With regard to Phase I bond release, the approved reclamation plan for the <br />Munger Canyon Mine calls for: <br />1. Hillslope and drainage channel gradients and general design compliance; <br />2. Performance of the reconstructed topography. Symptoms of failure or instability such as <br />slumping or exposed highwalls were examined; <br />3. Hillslope design/function with regard to erosion; <br />4. Swales and depressions with regard to numbers of features and effect on post -mining land <br />use; <br />5. Blending of regraded land to undisturbed areas; <br />6. The functioning of drainages with regard to knickpoints, blending at disturbance <br />boundaries and channel erosion; <br />7. Erosional features; and <br />8. Drainage control for the reclaimed area, including upslope diversions. <br />PHASE II <br />Rule 3.03.1(2)(b) states, "Up to eighty-five percent of the applicable bond amount shall be released upon <br />Permit Number PEW Page 4 of 12 <br />
