Box 64 <br /> LaPorte, Colorado 80545 <br /> Re: Elkhorn#1 Mining Claim Plan; File No.M-2018-045; Need for State Mine Reclamation Permit <br /> Dear Mr. Rudolph, <br /> The Colorado Division of Reclamation,Mining and Safety(Division)has specific Rules and Regulations for Hard <br /> Rock, Metal, Designated Mining Operations and Prospecting, adopted by the Colorado Mined Land Reclamation <br /> Board in January 2015. These rules are in accordance with the Colorado Mined Land Reclamation Act (Title 34 <br /> Article 32). It has come to the attention of the Division that you may be conducting or are planning to conduct <br /> mineral operations at your claim that requires a mine reclamation permit or a notice of intent to conduct <br /> prospecting. The Division has assigned File ID number M-2018-045 to your claim. Please reference this File ID <br /> number on any correspondence you submit to the Division. <br /> As defined in the Act (34-32-103(8)), "mining operation"means the development or extraction of a mineral from <br /> its natural occurrences on affected land. These activities would need an approved mine reclamation permit with <br /> the Division. As defined in the Act (34-32-110), any person desiring to conduct limited mining operations may <br /> apply for the expedited processing of a mine reclamation permit under two categories: 110(l)—for operations on <br /> less than five acres; or 110(2) for operations on less than ten acres. Both categories limit material extractions to <br /> less than 70,000 tons of mineral or overburden or combination of the two per calendar year. <br /> As defined in the Act (34-32-103(12)), "prospecting" means the act of searching for or investigating a mineral <br /> deposit. These activities would require of you to obtain approval of a notice of intent to conduct prospecting <br /> operations application. <br /> An approved reclamation permit or an approved notice of intent to conduct prospecting is required prior to <br /> conducting any mineral mining activities or prospecting on your claim.
