8/19/2018
Mr. Martellaro and Mr. Misbach
Page 5
mine? If so, please provide copies to Steffens and Associates and/or Eagle's Nest
Mountain Ranch for the period since 2014.
Future SWSP and Mining Plans
Figure 1 shows that the ground water problem will be exacerbated when Mining Cell 5 is
opened for production. The current, post-mining reclamation plan shows that the water elevation in
Lake (Cell) 5 will be a mere 0.2 feet higher (8530) than the static level of the Love Pit South Pond
(8529.8). It should be emphasized that it is the reclamation plan after mining.
Dry mining of Cell 5 to an elevation similar to the current dewatering level of Cell 4 (8500)
would result in a east to west groundwater gradient of 30 feet. It would have a substantial
deleterious effect on the Love Pit wetlands and the Blue River because it is directly across Highway
9 from Love Pit South Pond and would have a more direct hydrological connection to Blue River.
The resolution of the current issues should therefore be applied to future approvals of the well
permit and SWSP for Cell 5.
Please consider these complaints and grievances. And please contact either me or the
Summit Capital staff if you have any questions. Their objective is to finally resolve these issues with
ground water impacts that have been the subject of discussions with the Mine since 2004.
Sincerely,
Steven D.
