7. Rule 1. 13.5(2) requires a notice for an initial period of Temporary <br />Cessation to include the date of cessation, reasons for non -production or cessation, a <br />plan for resumption of mining, measures to be taken to comply with reclamation <br />requirements or other performance standards while the mine in temporary <br />cessation, and demonstration that the financial warranty is adequate. Operator has <br />provided the required information in its notice of temporary cessation. <br />8. Operator complied with the notice of the initial period of Temporary <br />Cessation as set forth in the Act and Rules. <br />9. Pursuant to Rule 1.13.6(2), the Board may, following a meeting where <br />a notice of temporary cessation is considered, may take whatever action it deems <br />necessary, including accepting the notice of temporary cessation submitted by an <br />Operator. <br />Based on the foregoing findings of fact and conclusions of law, the Board <br />hereby ACCEPTS the notice of Temporary Cessation submitted by Thomas F. and <br />Ginger L. Latham.
