Tht Applicant shall comply at all <br /> times with the provisions of the Photometric Plain, Drainage Report, Emergency <br /> Response Plan,Waste Disposal Plan,Noise and Air Pollution Plans, and Dust <br /> Suppression.Plans,as set forth in the application, including materials previously <br /> submitted to Grand County. <br /> } 9. Term and Expiration. That the initial term of the Conditional Use Permit shall <br /> be for a period of two(2)years. After the end of such period,the Board of <br /> ( ( TrUSteeS may review the Conditional Use Permit, and at the Board's option, add <br /> or delete conditions based on operation of the facility and compliance with the <br /> conditions of the Conditional Use Permit. In the event the Property is not used for <br /> a gravel pit:for a period of six months or longer,then such use shall be deemed <br /> terminated and of no effect. <br /> 10. Transfer or Assignment. The Conditional Use Permit that is being <br /> recommended for approval relates only the Applicant and is based,in pail, on the <br /> presentations and representations by the Applicant. The Conditional Use.Permit <br /> shall not be transferred by the Applicant without the Board of Trustees' written <br /> consent, following such hearings or investigation as the Board deems appropriate. <br /> 11. Limitation of Liability. By issuing this Conditional Use Permit the Town of <br /> Granby assumes no responsibility for the operation of the Applicant's site and the <br /> Applicant shall covenant and agree to hold the Town of Granby harmless for any <br /> inj ury, damages or claims which may occur,of whatever type of nature, as the <br /> result of the uses or operations contemplated by this permit. The Applicant <br /> warrants that appropriate liability and hazard insurance will be obtained to <br /> compensate any individual who may be injured or damaged in any manner by <br /> conduct relating to this permit or operation under this permit. Such liability and <br /> hazard insurance shall continue in eflfcct so long as the Property is used as a gravel <br /> pit. The Applicant shall further warrant and agree to compensate the`1'o"vn of <br /> Granby for any expense inci.nTed in the defense of any lawsuit or any other type of <br /> action which may be brought against the Town as a result of issuing this <br /> conditional use permit or operations under the conditional use permit. <br /> 12. Annexation. The Board's approval of the conditional use permit is conditioned <br /> on the completion of the annexation of the Property into the Town of Granby. <br /> 13. In the event of a conflict between or among the provisions of the Agreement and <br /> any of the other documents or regulations and laws relating to this conditional use <br /> permit or the operation of the gravel permit,the more restrictive provision shall <br /> control. <br />
