Please <br /> address the comments noted in the letter and make any changes to the application as needed. <br /> Response: There are no known wetlands or waters of the United States associated with this <br /> operation. (The drainage to which the operation supplies runoff is to an ephemeral drainage <br /> and is not considered waters of the U.S.) Therefore,the Corps requirement should not apply to <br /> this operation. <br /> Item 6.4.4 Exhibit D—Mining Plan: <br /> 4. Questions: The Applicant states an asphalt batch plant will be installed at the site. Please <br /> provide evidence the operation of an asphalt plant is acceptable under the Elbert County <br /> Zoning regulations and special use permit. <br /> Response: The reference to an asphalt batch plant being on the site has been removed from the <br /> Mine Plan. Please see attached and revised page 22. <br /> 5. Question: The Applicant states topsoil and overburden, if any, will be placed in stockpiles <br /> until needed for site reclamation. Please commit to seeding the topsoil and overburden <br /> stockpiles within 180 days of placement with the proposed topsoil stabilization seed mix to <br /> stabilize and protect the stockpiles from erosion pursuant to Rule 3.1.9. <br /> Response: We commit to seeding the topsoil and overburden stockpiles to the approved seed <br /> mix within 180 days of placement. Please see enclosed pages 31, and 32. <br /> 6. Question: The Applicant states the ephemeral drainage should not be impacted.significantly <br /> by the mining operation since appropriate Best Management Practices (BMP)s will be part of <br /> the proposed expansion operation. Please provide the Division with the BMP plan to prevent <br /> impacts to the ephemeral drainage. <br /> Response: A Stormwater Management Plan is attached. An application will be submitted to <br /> the Water Quality Control Division(WQCD). The DRMS will receive a copy when the <br /> WQCD approves the application. <br /> Item 6.4.5 Exhibit E—Reclamation Plan: <br /> 7. Question: The Applicant states in Section 3.1.6(3), all topsoil piles if not added to or used <br /> within two years, will be seeded with the approved topsoil stabilization seed mix.
