Sherri Burton 8/14/2018
Rock and Rail, LLC.
501 S 91"Street
Canon City, Colorado 81212
Re; Structure Agreement
Sherri,
We previously got in touch with you on 7/20/2018 concerning the public notice for the placer mining
that we do on the South side of the river at Parkdale. After submitting that record to the Colorado
Division of Reclamation, Mining, and Safety, they notified us that since we are within 200 feet of the
tracks(considered a "structure") we will also need to also make a "structure agreement" with Rock and
Rail.
As we stated previously,we will not be performing any work on the North side of the river,or be on or
near railroad property at any time. We fully intend to remain on the South side of the river and continue
with the limited placer mining operations as we have done in previous years.
It is hard to imagine a scenario where we would have any impact to the railroad property. All of our
work is by hand (pick and shovel), and we do not do any blasting. We also do not use any mechanized
equipment(excavators, etc.). Presently our deepest excavation is only about 15 feet deep and is limited
to the groundwater elevation which fluctuates with the river level.
Please see the attached "Structure Agreement". It would be a great favor to us if you could have it
signed, notarized, and then return it to me. I have also enclosed a self-addressed,stamped envelope for
your convenience.
If you have any questions or concerns, please feel free to give me or Tom a call.
Thanks,
,c
Joe Lovett
507 Greenwood Ave.
Canon City, CO. 81212
719-285-5518
Tom Zimmerman
45781 W US Highway 50
Canon City, CO. 81212
719-371-5609
