Sherri Burton 8/14/2018 <br /> Rock and Rail, LLC. <br /> 501 S 91"Street <br /> Canon City, Colorado 81212 <br /> Re; Structure Agreement <br /> Sherri, <br /> We previously got in touch with you on 7/20/2018 concerning the public notice for the placer mining <br /> that we do on the South side of the river at Parkdale.After submitting that record to the Colorado <br /> Division of Reclamation, Mining, and Safety,they notified us that since we are within 200 feet of the <br /> tracks(considered a "structure") we will also need to also make a "structure agreement" with Rock and <br /> Rail. <br /> As we stated previously,we will not be performing any work on the North side of the river,or be on or <br /> near railroad property at any time. We fully intend to remain on the South side of the river and continue <br /> with the limited placer mining operations as we have done in previous years. <br /> It is hard to imagine a scenario where we would have any impact to the railroad property.All of our <br /> work is by hand (pick and shovel), and we do not do any blasting. We also do not use any mechanized <br /> equipment(excavators, etc.). Presently our deepest excavation is only about 15 feet deep and is limited <br /> to the groundwater elevation which fluctuates with the river level. <br /> Please see the attached "Structure Agreement". It would be a great favor to us if you could have it <br /> signed, notarized, and then return it to me.
