Summit Cappal LLC RE'CEivEl)
August 17,2018 DIVISION OF RECLA!!
MINING b Ste"
Mr. Eric Scott
Summit County Gravel Mining Inspector/Specialist
Colorado Division of Reclamation, Mining, and Safety
1313 Sherman Street, Room 215
Denver, CO 80203
Re: Impact to Love Pit Mitigation Wetlands(M1982164)by Maryland Creek
Ranch Gravel Mining(M1996049)
Dear Mr. Scott:
Summit Capital, LLC manages the Eagle's Nest Mountain Ranch, north of Silverthorne,
which was previously mined for gravel and sand by Everist Materials, LLC (Everist) under Colorado
Department of Reclamation, Mining, and Safety (DRMS) Permit M1982164. The mining property
was known as the Love Pit. Impacts to the water supply of those wetlands by gravel and sand mining
immediately west of the Love Pit by Kilgore Companies, dba Peak Materials (Peak), the operator and
permittee for the Maryland Creek Ranch mine, regulated by the DRMS under Permit M1996049, are
the subject of this letter.
The Love Pit permit was closed by DRMS after fmal acceptance of the Mitigation Wetlands
by the Corps of Engineers in 2004. At that time, the previous owner of the Eagle's Nest Mountain
Ranch expressed concerns to the Corps and to Everist about post-mining impacts to the water supply
of the Love Pit wetlands. The Love Pit water supply is groundwater flowing from the west (the
Maryland Creek Ranch) beneath US Highway 9. Everist used a dredging, or"wet", mining method
for extraction of the sand and gravel from the Maryland Creek Ranch mine, which did not create
observed impacts to the Love Pit water supply because the high water table was maintained.
However, the planned elevations of the post-reclamation lake levels in the mining plan for Maryland
Creek Ranch were lower than the Love Pit wetlands and would have curtailed the supply. Everist
revised the lake level elevations in February 2010 and made other revisions as part of Amendment No.
2 to their permit.
R O, Box 610 • Littleton, CO 80160 603) 536-5408 Fax 603) 459-6571
