The mining property <br /> was known as the Love Pit. Impacts to the water supply of those wetlands by gravel and sand mining <br /> immediately west of the Love Pit by Kilgore Companies, dba Peak Materials (Peak), the operator and <br /> permittee for the Maryland Creek Ranch mine, regulated by the DRMS under Permit M1996049, are <br /> the subject of this letter. <br /> The Love Pit permit was closed by DRMS after fmal acceptance of the Mitigation Wetlands <br /> by the Corps of Engineers in 2004. At that time, the previous owner of the Eagle's Nest Mountain <br /> Ranch expressed concerns to the Corps and to Everist about post-mining impacts to the water supply <br /> of the Love Pit wetlands. The Love Pit water supply is groundwater flowing from the west (the <br /> Maryland Creek Ranch) beneath US Highway 9. Everist used a dredging, or"wet", mining method <br /> for extraction of the sand and gravel from the Maryland Creek Ranch mine, which did not create <br /> observed impacts to the Love Pit water supply because the high water table was maintained. <br /> However, the planned elevations of the post-reclamation lake levels in the mining plan for Maryland <br /> Creek Ranch were lower than the Love Pit wetlands and would have curtailed the supply.
