RULE 2 PERMITS Colowyo Coal Company L.P., 5731 State Highway 13, Meeker, CO 81641 State of Colorado, 1313 Sherman Street, Room 620, Denver, CO, 80203, Bureau of Land Management, 455 Emerson Street, Craig, CO, 81625, The legal or equitable owner of record of the coal to be mined is the United States of America, the State of Colorado, and Guy and Holmes Shefstead, P.O. box 608, Craig, Colo. 81626 Colowyo is the holder of Federal Coal Leases No. D-034365, C-35874, C-29224, C-29225, C- 29226, C-0123475, C-0123476, COC -68590. Colowyo is also the holder of State of Colorado Coal Lease 257-13S. The surface and mineral ownership in the permit and adjacent areas is graphically shown on the Surface Ownership Map (Map 1) and the Coal Ownership Map (Map 2) and the information found in Exhibit 1, Documents and Leases. Colowyo is the only holder of record of any leasehold interest in the property to be mined or to be affected by surface operations and facilities incidental thereto. There are no other holders of record of any leasehold interests for areas located within the property boundary. There is no pending purchaser of record of any surface or mineral estate under a real estate contract for areas located within the permit boundary. Information regarding the internal Permit area and contiguous surface and subsurface ownership may be found in Exhibit 1, Item 11. 2.03.5 Compliance Information The Applicant, Colowyo, its subsidiaries, affiliates, or persons controlled by or under common control with the applicant has not had a federal or state mining permit for surface coal mining operations suspended or revoked in the last five years; or forfeited a mining bond or similar security deposited in lieu of bond. Since no suspension, revocation, or forfeiture has occurred, Part 2.03.5(2) is not applicable to this application. A list of violation notices received during the last three years by Colowyo in connection with the surface coal mining operation is provided in Exhibit 2, Item 3, Volume 2A which is periodically updated by Colowyo. The list of violation notices received by those companies related through the "ownership and control" relationship is also provided in Exhibit 2, Item 3. 2.03.6 Right of Entry and Operational Information The documents in Exhibit 1, Documents and Leases, vest the rights shown in and to surface estate within the permit area.
