Summary <br />The Review Process <br />Twentymile Coal, LLC (TC), a subsidiary of Peabody Investments Corporation, submitted a <br />permit renewal application (RN -07) for the Foidel Creek Mine. The Foidel Creek Mine is <br />exclusively an underground coal mining operation located approximately 22 miles southwest of <br />Steamboat Springs, Colorado in Routt County. Permit No. C-82-056 was issued on May 23, <br />1983, and has been renewed every five years since that date. <br />For the current renewal RN -07, the Division notified TC by letter on August 21, 2017 that its <br />permit for the Foidel Creek Mine would expire on May 23, 2018. The letter explained that, for <br />operations to continue beyond that date, Section 2.08.5(3)(f) requires an application for renewal <br />to be received on or before November 24, 2017. TC submitted a renewal application on October <br />27, 2017 and the application was found complete on November 6, 2017. TC published a notice <br />of the application in the Steamboat Pilot, over four consecutive weeks from November 12, 2017 <br />through December 3, 2017. <br />No objections regarding the application were received. The applicant violator system (AVS) was <br />last queried on July 18, 2018, and resulted in a recommendation to approve this renewal. <br />A conference call was held on October 12, 2017 with the purpose of discussing certain <br />outstanding permitting actions. Foidel Creek Mine Mid -Term Review MT7 (dated 11/23/15) was <br />one of the items discussed. As a result of the conference call, TCC and the Coal Program agreed <br />that the Coal Program would incorporate unresolved issues raised in Foidel Creek Mine Mid - <br />Term Review MT7 into the Coal Program's review of Foidel Creek Mine Permit Renewal <br />Application RN7. <br />On May 30, 2018, the Division sent an adequacy letter to TC requesting additional information <br />with regards to portions of the permit. TC provided partial responses to the Division's adequacy <br />letter in a letter received April 2, 2018 and the remaining items were received by Division on <br />May 2, 2018. The Division sent a second adequacy letter to TC requesting additional <br />information with regards to portions of the permit on May 31, 2018. TC provided responses to <br />the Division's adequacy letter in a letter received July 9, 2018. The Division updated the <br />Reclamation Cost Estimate on May 14th, 2018 and incorporated revisions through issuance date <br />7/5/2018 (TR90). All adequacy concerns have been resolved; therefore, the Division proposes to <br />approve the renewal application. <br />Publication of this proposed decision initiates a thirty -day public comment period. Provided there <br />are no objections to the decision, the proposed decision will become final at the close of the <br />comment period. <br />Foidel Creek Mine 4 August 10, 2018 <br />
