No mining will occur within jurisdictional wetlands. However, the North Haul Road will cross <br />Meehan Draw as shown on Map 2.05.3(3)-3. Construction, maintenance, and reclamation <br />activities associated with the crossing include but are not limited to: <br />• Topsoil will be salvaged outside of the wetland areas prior to disturbance within <br />delineated wetlands. <br />• Heavy equipment working in wetland areas must be placed on mats or other measures <br />must be taken to minimize soil disturbance. <br />• Synthetic fabric will be placed beneath the temporary fill in order to separate the fill <br />material from the wetland soils. <br />• Appropriate soil erosion and sediment controls will be used and maintained in effective <br />operating condition during construction. All exposed soil and other fills will be <br />permanently stabilized at the earliest practicable date. NHN will also attempt to perform <br />work during periods of low -flow or no -flow. <br />• The North Haul Road and fill area will be properly maintained, including maintenance to <br />ensure public safety and compliance with applicable NWP general conditions. <br />• The temporary fill material will be removed in its entirety and the affected areas returned <br />to pre -construction elevations upon completion of mining and reclamation activities north <br />of Meehan Draw. <br />• Upon removal of the temporary fill material, the affected areas will be vegetated using <br />the Dryland Pasture revegetation procedures described in Section 2.05.4(2)(e). <br />The disturbance to this wetland area will be mitigated as described in NHN's Nationwide <br />General Permit No. 21 - Surface Coal Mining Activities (Section 404) from the U.S. Army Corp <br />of Engineers. A copy of the approved Nationwide 21 permit is on file at the New Horizon Mine <br />office and available for review at the Division's request. <br />Prior to initiating any disturbance of the proposed Equipment Corridor, the application must be <br />revised to satisfactorily address the performance standards of Rule 4.03.3 - Light Use Roads. <br />Additionally, no work may proceed related to the crossing of Tuttle Draw until a 404 permit <br />issued by the U.S. Army Corps of Engineers has been provided to the Division. <br />Section 2.05.6(2) Page 6 May 2017 (MR -19) <br />
