W'/2 SWI/4 Section 33 <br />The additional study data will be forwarded to the Office of Archaeology & Historic Preservation <br />(within History Colorado) for their evaluation and a determination of the proper course of action <br />required. <br />Stipulation 7 <br />The Colowyo Coal Company shall submit a Technical Revision (TR) to the Division which <br />provides an analysis of groundwater points of compliance at the Colowyo Mine pursuant to Rule <br />4.05.13(1). This analysis will be done in consultation with the Division and will include a written <br />determination of the need for groundwater points of compliance at the mine. If deemed <br />appropriate, based on this analysis, Colowyo shall establish one or more points of compliance for <br />the Colowyo Mine. <br />Stipulation 19 <br />Dewatering well permits must be in place, and a minor revision be submitted and approved by the <br />Division to update Section 2.03.10 of Volume 1 of the Permit Application Package, before any <br />construction of any dewatering wells associated with the Collom Pit is allowed to occur. <br />Stipulation 20 <br />Prior to disturbing any lands in the Lower Wilson area, the Colowyo Coal Company shall <br />provide the Division with a PERMIT revision containing a mine plan and a reclamation plan and <br />any additional baseline monitoring information (surface water, ground water, soils, vegetation, <br />etc.) requested by the Division. The approval of Permit Revision 02 is only an approval for <br />disturbance in the South Taylor Pit (South Taylor Pit, West Valley Fill, East Valley Fill and <br />associated structures). NO DISTURBANCE IS APPROVED FOR THE LOWER WILSON <br />AREA WITH THE APPROVAL OF PERMIT REVISION 02. <br />Stipulation 23 <br />An individual discharge permit must be in place, and a minor revision to the permit submitted <br />and approved by the Division to update Section 2.03. 10 of Volume 1 of the Permit Application <br />Package, before overburden stockpiling within the Collom Temporary Spoil Pile (not including <br />topsoil removal, sediment pond development or access/haul road development) can occur. <br />3.0 History of the Review Process <br />The application for this Permit Renewal (RN -07) was submitted to the Division on April 14, 2017 <br />by Colowyo. Pursuant to Rule 2.08.5(3)(f), Colowyo submitted the RN -07 application more than <br />180 -days prior to the permit expiration and retains the right of successive renewal. <br />Revised Proposed Decision and Findings of Compliance August 2018 <br />Permit Renewal No. 7 Page 14 <br />
