Derr Pit SWSP August 1, 2018 <br /> Plan ID 5240 Page 4 of 6 <br /> 1. This SWSP shall be valid for the period of August 1, 2018 through July 31, 2019, unless <br /> otherwise revoked or superseded by decree. If a court decreed plan for augmentation is not <br /> obtained for the proposed uses by the SWSP expiration date, a renewal request must be <br /> submitted to this office with the statutory fee of $257 no later than June 1, 2019. If a <br /> renewal request is received after the expiration date of this plan, it will be considered a <br /> request for a new SWSP and the $1,593 filing fee will apply. <br /> 2. A well permit application has been submitted under receipt no. 3686683 for the current use <br /> and exposed surface area of the gravel pit in accordance with Section 37-90-137(2) and (11), <br /> C.R.S., in conjunction with this plan. The provisions of Section 37-90-137(2), C.R.S., prohibits <br /> the issuance of a permit for a well to be located within 600 feet of any existing well, unless <br /> the State Engineer finds that circumstances so warrant after a hearing held in accordance <br /> with the procedural rules in 2CCR402-5. Should a new well permit be denied for reasons of <br /> 600 foot spacing, or any other legitimate reason, approval of this substitute supply plan may <br /> be cancelled. <br /> 3. The total surface area of the groundwater exposed at the Derr Pit must not exceed 0.75 <br /> acres, which results in an annual net evaporative loss of 2.188 acre-feet. <br /> 4. The annual amount of water used for operational purposes at the Derr Pit shall not exceed <br /> 9.41 acre-feet, estimated as 5.00 acre-feet for dust suppression and 4.41 acre-feet lost with <br /> the production of 300,000 tons of mined product. <br /> 5. Total consumption at the Derr Pit must not exceed these aforementioned amounts unless an <br /> amendment is made to this SWSP. <br /> 6. Approval of this SWSP is for the purposes as stated herein. This office must first approve any <br /> additional uses for the water. <br /> 7. Replacement water shall be made available to cover all out-of-priority depletions in time, <br /> place, and amount and shall be made available under the direction and/or approval of the <br /> water commissioner. Notice must be provided and approval made by the water commissioner <br /> at least 48 hours prior to the release of replacement water, or as required by the water <br /> commissioner. <br /> 8. The release of replacement water may be aggregated to maximize beneficial use. The water <br /> commissioner and/or the division engineer shall determine the rate and timing of an <br /> aggregated release. <br /> 9. The replacement water that is the subject of this SWSP cannot be sold or leased to any other <br /> entity. As a condition of subsequent renewals of this SWSP, the replacement water must be <br /> appurtenant to this site until a plan for augmentation is obtained. <br /> 10. All diversions shall be measured in a manner acceptable to the division engineer. The <br /> Applicant shall install and maintain such measuring devices as required by the division <br /> engineer for operation of this SWSP. <br /> 11. The Applicant shall provide daily accounting (including, but not limited to diversions, <br /> depletions, replacement sources, and river calls) on a monthly basis, or more frequent if <br /> required by the water commissioner. The accounting must be emailed to the water <br /> commissioner (Mark Simpson at Mark.Simpson@state.co.us) and <br /> DNR DivlAccountinq@state.co.us within 30 days of the end of the month for which the <br /> accounting applies. Accounting and reporting procedures are subject to approval and <br /> modification by the division engineer. Accounting forms need to identify the WDID number <br />
