1. This SWSP shall be valid for the period of August 1, 2018 through July 31, 2019, unless
otherwise revoked or superseded by decree. If a court decreed plan for augmentation is not
obtained for the proposed uses by the SWSP expiration date, a renewal request must be
submitted to this office with the statutory fee of $257 no later than June 1, 2019. If a
renewal request is received after the expiration date of this plan, it will be considered a
request for a new SWSP and the $1,593 filing fee will apply.
2. A well permit application has been submitted under receipt no. 3686683 for the current use
and exposed surface area of the gravel pit in accordance with Section 37-90-137(2) and (11),
C.R.S., in conjunction with this plan. The provisions of Section 37-90-137(2), C.R.S., prohibits
the issuance of a permit for a well to be located within 600 feet of any existing well, unless
the State Engineer finds that circumstances so warrant after a hearing held in accordance
with the procedural rules in 2CCR402-5. Should a new well permit be denied for reasons of
600 foot spacing, or any other legitimate reason, approval of this substitute supply plan may
be cancelled.
3. The total surface area of the groundwater exposed at the Derr Pit must not exceed 0.75
acres, which results in an annual net evaporative loss of 2.188 acre-feet.
4. The annual amount of water used for operational purposes at the Derr Pit shall not exceed
9.41 acre-feet, estimated as 5.00 acre-feet for dust suppression and 4.41 acre-feet lost with
the production of 300,000 tons of mined product.
5. Total consumption at the Derr Pit must not exceed these aforementioned amounts unless an
amendment is made to this SWSP.
6. Approval of this SWSP is for the purposes as stated herein. This office must first approve any
additional uses for the water.
7. Replacement water shall be made available to cover all out-of-priority depletions in time,
place, and amount and shall be made available under the direction and/or approval of the
water commissioner. Notice must be provided and approval made by the water commissioner
at least 48 hours prior to the release of replacement water, or as required by the water
commissioner.
8. The release of replacement water may be aggregated to maximize beneficial use. The water
commissioner and/or the division engineer shall determine the rate and timing of an
aggregated release.
9. The replacement water that is the subject of this SWSP cannot be sold or leased to any other
entity. As a condition of subsequent renewals of this SWSP, the replacement water must be
appurtenant to this site until a plan for augmentation is obtained.
10. All diversions shall be measured in a manner acceptable to the division engineer. The
Applicant shall install and maintain such measuring devices as required by the division
engineer for operation of this SWSP.
11. The Applicant shall provide daily accounting (including, but not limited to diversions,
depletions, replacement sources, and river calls) on a monthly basis, or more frequent if
required by the water commissioner. The accounting must be emailed to the water
commissioner (Mark Simpson at [e-mail]) and
DNR [e-mail] within 30 days of the end of the month for which the
accounting applies. Accounting and reporting procedures are subject to approval and
modification by the division engineer. Accounting forms need to identify the WDID number
