OPERATORS <br /> SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br /> WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br /> Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br /> Reclamation Board will consider possible enforcement action. <br /> INSPECTION TOPIC: Records— Failure to Notify DRMS as required by Rule 8.1 and C.R.S. 34-32.5-121(2). <br /> PROBLEM/POSSIBLE VIOLATION: Possible Violation: Emergency Notification by Operators- Rule 8.1. Operators shall <br /> notify the Office, as soon as reasonably practicable, but no later than 24 hours, after the Operator has knowledge of a <br /> failure or imminent failure of any impoundment, embankment, stockpile or slope that poses a reasonable potential <br /> danger to persons or property. <br /> CORRECTIVE ACTIONS:This possible violation will require a hearing before the Mined Land Reclamation Board.The <br /> schedule and other details for the MLRB hearing will be provided under a separate document to be sent via certified mail <br /> to the operator. <br /> Operator will also be required to submit documentation in accordance with Rule 8.2.3 - Follow-up Notice Requirements as <br /> soon as practicable. If all required information is not yet available, the operator shall provide a timeline to submit the <br /> required information. <br /> CORRECTIVE ACTION DUE DATE: 7/20/18—complied with follow up documentation <br /> INSPECTION TOPIC: Off-Site Damage <br /> PROBLEM/POSSIBLE VIOLATION: Possible Violation: Failure to first obtain a reclamation permit prior to engaging in a <br /> new mining operation as required by C.R.S. 34-32.5-109(1). Land has been affected outside of the approved permit <br /> boundary over 2 acres. Pursuant to C.R.S. § 34-32.5-123(2) an operator who mines substantial acreage beyond the <br /> approved permit boundary may be found to be operating without a permit. <br /> Page 1 of 5 <br />
