("Holcim" or "Applicant"). The Applicant has filed an application for approval of a <br />plan for augmentation with the Division 2 Water Court in case no. 16CW3102, to replace <br />out -of -priority diversions resulting from evaporation of exposed groundwater and use of <br />exposed water from dust suppression at the quarry pits. Notice was sent to all parties to case <br />no. 16CW3102 on October 31, 2017. No comments were received during the statutory 35 -day <br />comment period. The statutory $300 filing fee has been received and given receipt no. <br />3683348. <br />Pursuant to S 37-92-308(4)(b), C.R.S., "If an applicant requests renewal of a plan that would <br />extend the plan past five years from the initial date of approval, the applicant shall <br />demonstrate to the water judge in the applicable water division that the delay in obtaining a <br />decree has been justifiable and that not being able to continue operating under a substitute <br />water supply plan until a decree is entered will cause undue hardship to the applicant." An <br />order from the Division 2 water court dated December 12, 2017 granted the Motion for <br />Determination of Justifiable Delay.
