The following item is incomplete for the application <br /> to be processed: <br /> 1. Structure Agreement for one house,three outbuildings,concrete ditches and a barbed wire fence owned by <br /> Hugh Carver on the north side of the property. <br /> Structure Agreement requirements per the Construction Materials Rules and Regulations, "Where the mining <br /> operation will adversely affect the stability of any significant, valuable and permanent man-made structure <br /> located within two hundred (200) feet of the affected land, the applicant may either: provide a notarized <br /> agreement between the applicant and the person(s) having an interest in the structure, that the applicant is to <br /> provide compensation for any damage to the structure; or where such an agreement cannot be reached, the <br /> applicant shall provide an appropriate engineering evaluation that demonstrates that such structure shall not be <br /> damaged by activities occurring at the mining operation;or where such structure is a utility,the Applicant may <br /> supply a notarized letter, on utility letterhead, from the owner(s)of the utility that the mining and reclamation <br /> activities,as proposed, will have "no negative effect"on their utility." <br /> Per the incompleteness notification on May 22,2017, the required documentation is due to the Division before July <br /> 17,2018 to complete the application for approval. All completed permit documents are required to be submitted for <br /> consideration of your Request for Transfer of Mineral Permit and Succession of Operators Application.An incomplete <br /> application will be denied after the 60 day submittal request, if requested documents or information are not received. <br /> Please contact me in the event of any delay in your submittal.
