EXHIBIT S - PERMANENT MAN-MADE STRUCTURES <br /> The information provided in this Exhibit is intended to satisfy the requirements outlined in Section <br /> 6.4.19 of the Colorado Mined Land Reclamation Board Construction Material Rules and <br /> Regulations. <br /> Where mining will adversely affect the stability of any significant, valuable or permanent <br /> man-made structure located within 200 feet of affected land, the applicant may either: <br /> a) Provide a notarized agreement between the applicant and the person(s)having <br /> an interest in the structure, that the applicant is to provide compensation for any <br /> damage to the structure;or <br /> b) The applicant shall provide an appropriate engineering evaluation that <br /> demonstrates that such structure shall not be damaged by activities occurring <br /> at the mining operation:or <br /> c) Where the structure is a utility, the Applicant may supply a notarized letter stating <br /> that the mining and reclamation as proposed will have no negative effect on their <br /> utility. <br /> The known, permanent, man-made structures within 200 feet of the proposed mine areas <br /> are listed as follows: <br /> • TRICYCLE LANE TEXAS LLC <br /> • VARIOUS BUILDINGS OWNED BY LAND OWNER <br /> • WCR 14 1/5 & ROW(WELD COUNTY PUBLIC WORKS) <br /> • OVERHEAD POWER LINE (NORTHERN & SOUTHERN <br /> BOUNDARY)(UNITED POWER) <br /> • OVERHEAD POWER LINE (WESTERN BOUNDARY)(UNITED <br /> POWER) <br /> • OVERHEAD POWER LINE (WCR 14 1/2) (UNITED POWER) <br /> • VARIOUS GAS LINES (KERR-MCGEE/ANADARKO, & KID <br /> KAUFMAN) <br /> • INOUYE 44-36 WELL HEAD (KP KAUFMAN) <br /> • FUNAKOSHI SAM GU NO2(KERR-MCGEE/ANADARKO) <br /> • INOUYE 9-36A WELL HEAD (KERR-MCGEE/ANADARKO) <br /> • GRASSHOPPER WELL HEAD (KERR-MCGEE/ANADARKO) <br /> • INOUYE 11-31A WELL HEAD (KERR-MCGEE/ANADARKO) <br /> • VYNCKIER DONALD GU B NO2 (KERR-MCGEE/ANADARKO) <br /> • NOUYE 15-31A WELL HEAD (KERR-MCGEE/ANADARKO) <br /> • FIBER OPTIC IN WCR 141/2 ROW(CENTURY LINK) <br /> • LUPTON BOTTOM DITCH <br /> Please refer to the attached engineering stability analysis that shows that structures shall <br /> not be damaged by activities occurring at the mining operation. <br /> Burnco Colorado, LLC—Inouye Gravel Mine—MLRB 112 Permit Amendment Application <br /> Exhibit S- 1 <br />
