Updated third -party financial warranty documents, required from Consolidated <br />Constructors. <br />2. Updated documentation regarding significant manmade structures. <br />We are nearing the deadline for completing these actions. This letter requests <br />an extension to that deadline, for reasons explained below. WASTELINE Inc. and <br />RCKE have been working to obtain this documentation, but have been delayed and <br />thwarted by unanticipated and unusual circumstances. <br />The primary delay is determining the type, status, and ownership of the fenced <br />pad on the western edge of the permitted area, on CRA 36. Indications of a pipeline <br />along the east side of CRA 36 were found, although local utilities and other companies <br />in the area were unaware of that line's existence. Originally thought to be abandoned, <br />the fenced pad and the pipeline are now claimed by at least two different owners. <br />We have made multiple attempts to contact the appropriate persons authorized <br />to act for the two firms. But until we can do so, and request an agreement from them, <br />we understand the Division cannot accept an engineering evaluation of geotechnical <br />stability. (It is my professional opinion, based on my inspection of the site and the <br />currently -permitted activities at the pit, that there is no significant potential for negative <br />impact on those identified structures by permitted activities at the Pit.) <br />Although it is unlikely to take so long, I am requesting a one-month extension to <br />obtain this documentation. In addition to the third -party financial warranty documents, <br />we may need to request a waiver to the usual process for requesting an indemnity <br />agreement, and to proceed directly to an engineering evaluation. <br />Respectfully, <br />y; <br />Nathan A.
