Mr. Scott <br /> Response to Adequacy Review of a 112 Construction Materials Reclamation Permit Amendment <br /> Package, Derr Pit, Permit M2008-017 <br /> Page 3 <br /> measure the depth of each well and submit that information to the Division for your <br /> records. We can find no evidence that permits for the wells have been obtained based on <br /> our research of the Division of Water Resources well permit information. Broken Arrow <br /> will permit the wells and submit the approved permits to the Division for your records <br /> when the approved permits are obtained. <br /> 5. Both proposed reclamation plans show the northern reservoir containing existing utilities <br /> and what appears to be a ditch. The mining plan shows they will be relocated at some <br /> point. Have agreements already been reached to relocate these features? Who owns <br /> the ditch? The ditch should be included in the structures exhibit unless it is fully owned <br /> by Broken Arrow. <br /> Response: <br /> Agreements to relocate the utilities have not yet been finalized. Broken Arrow will <br /> maintain a minimum setback of 200 feet from the utilities until either they are relocated or <br /> damage waivers are obtained from the owners. The ditch is an abandoned irrigation <br /> lateral that is wholly owned by Global Asset Recovery, with whom a damage waiver <br /> agreement has been obtained. <br /> The submitted geotechnical evaluation does not include any sections along the west or <br /> south side of phases 1-4 of the mining plan where the excavation and slurry wall are <br /> considerably closer to the south and west permit boundaries and structures. <br /> Response: <br /> A separate geotechnical evaluation was done for the original permit area that included <br /> sections on the west and south side of phases 1-4. See the attached geotechnical <br /> evaluation dated March 2008. <br /> There is also no demonstration that the offsets shown on the mining plan map (50' offset <br /> from the gas well and 25' offset from the line shown in Phase 5, or the distance to the <br /> existing facilities north of Phase 5) are adequate. Please address. If these facilities will <br /> be relocated, then the permittee will need to commit to staying 200' from them until they <br /> are removed. <br /> Response: <br /> The gas well is currently shut in and is planned to be plugged and abandoned. The gas <br /> line, and facilities are planned to be abandoned and removed. Broken Arrow commits to <br /> maintaining a minimum setback of 200 ft from the gas well, gas line, and facilities north <br /> of Phase 5 until a surface use agreement is obtained with the owner, a damage waiver is <br /> obtained from the owner, or the facilities are abandoned and removed.. <br /> Gas wells immediately north of NE corner of Phase 1 will also need to be addressed and <br /> the owner identified on figure C-2 for Exhibit S, as well as gas/oil structures in the parcel <br /> in the west center of the permit. <br /> Response: <br /> V 305 Denver Avenue—Suite D• Fort Lupton CO 80621 • Ph: 303-857-6222 • Fax: 303-857-6224 <br />
