Subsequent to the issuance of the Peabody Sage Creek Mine Permit, additional disturbed area acres were <br />approved to be disturbed via various revisions. These brought the approved disturbance to 1912.80 <br />acres. The PSCM has three approved bond releases as summarized as follows: <br />SL -1: The Division approved Phase II bond release for 445.8 acres of interim program and <br />permanent program lands on September 5, 2013. <br />SL -2: The Division approved Phase II and III release for 68.79 acres of pre -law lands on January <br />30, 2014. <br />SL -3: The Division approved Phase III release of 1026 acres of interim and permanent program <br />lands on April 8, 2015. <br />The remaining liability after the approval of PSCM SL -3 is shown in Table 2 below. <br />Table 2 — Remaining Liability Acreage at the Peabody Sage Creek Mine Post SL -3 <br />An application for Phase III bond release was received by the Division on January 20, 2017. The <br />application was deemed complete on February 16, 2017, after the Division received proof of publication <br />of the applicant's public notice. Peabody Sage Creek Mining, LLC published notice of the bond release <br />application in Steamboat Pilot once weekly for four consecutive weeks, beginning January 15, 2017. <br />Peabody Sage Creek Mining, LLC also notified land owners within and adjacent to the mine permit area, <br />and other interested parties of the application for bond release, as required by Rule 3.03.2(1). <br />No written objections or requests for an informal conference regarding the bond release application were <br />received by the Division. One comment letter was received on March 14, 2017, from Colorado Parks <br />and Wildlife (CPW) stating that CPW does not recommend any additional site-specific mitigation or <br />reclamation practices for the proposed bond release application. <br />The Division scheduled and conducted a bond release inspection on August 3rd 2017.
