28. Applicant's groundwater monitoring plan also measures rises in <br />groundwater levels and mitigation measures will be taken if levels rise more than <br />two feet above baseline levels. <br />29. Each pit will be surrounded by a drain system that redirects <br />groundwater around the pits to reduce mounding. If the drain system fails to drop <br />groundwater levels sufficiently, water will be pumped around the liner. <br />30. Applicant has conducted engineering surveys or has entered into <br />agreements with adjacent landowners regarding potential damage to offsite <br />structures. The site also has setbacks between the perimeter and excavations of <br />fifty to one hundred feet. <br />31. The Division presented testimony that it was satisfied that Applicant <br />had complied with the Act and Rules regarding hydrologic balance. <br />Enforcement Issues <br />32. Objectors testified regarding concerns with future enforcement of <br />Applicant's obligations under the Act and Rules. <br />33. The Division presented testimony stating that it had authority to <br />conduct inspections of the site, an obligation to report violations to the Board, and <br />that it pursued enforcement of violations. In addition to its own inspections, the <br />Division also responds to citizen complaints and does so within thirty days or, <br />regarding alleged serious environmental problems, as soon as possible. <br />Wildlife <br />34. The Colorado Department of Parks and Wildlife submitted a response <br />letter regarding the Application. Their letter stated that the proposed site was not <br />in a migration route for wildlife, contained no known raptor nests, and that there <br />will not be a negative impact on wildlife from the proposed project. <br />35. Applicant has a wildlife protection plan that includes a phased mining <br />plan with concurrent reclamation, fifty -foot buffer zones around the Little Cache La <br />Poudre Ditch, safety berms around the pit excavations, locations for egress from pit <br />areas, a ten -mile -per -hour speed limit for mine traffic in the site, and a raptor nest <br />monitoring and mitigation plan. <br />36. The site is not designated critical habitat for the Prebles Meadow <br />Jumping Mouse or other threatened or endangered species. <br />37.
