Questionnaire, <br />Permit Required. <br />Dear Mr. Roys: <br />On February 9, 2018 the Division of Reclamation, Mining, and Safety (Division) received information for an "Is It <br />Mining" questionnaire regarding a proposed project to search for gemstones at the above referenced site. <br />The Mined Land Reclamation Board has requested that the Division make determinations as to the need for a <br />Mined Land Reclamation Permit. Pursuant to the questionnaire and other information the Division has <br />determined that a permit is required. Based on the proposed disturbance of an acre it appears that a hard rock <br />110(1) permit which is for less than 5 acres will be required. The correct permit type may change if additional <br />information is reviewed. Here is the link to the 110 (1) permit application: <br />http://mining.state.co.us/SiteCollection Documents/Hardrockl10(1)App.pdf <br />If you have any concerns or disagree with this decision, you may petition to appear before the Board during a <br />formal public hearing for a Declaratory Order concerning this matter. Pursuant Rule 2.5.2 (1): the request must be <br />submitted to the Board in writing and be received no later than 10 days prior to the hearing. The written request <br />must contain the information required pursuant Rule 2.5.2 (2). (Rule 2.5 Enclosed) The next available Board <br />hearing will be held on March 21, 2018. All hearings are held at 1313 Sherman 5t., Room 318, in Denver, Colorado <br />80203.
