Box 271052 <br />Louisville, CO 80027 <br />RE: Need for State Reclamation Permit, Bighorn Spine Lode, File No. M-2018-008 <br />Dear Mr. Roys: <br />In a correspondence dated January 13, 2018, the Division of Reclamation, Mining and Safety <br />(Division) informed you of your obligation to obtain a reclamation permit prior to engaging in a <br />mining activity. On April 10, 2018, the Division received your revised correspondence, dated <br />April 5, 2018, responding to the Division's inquiry, RE: "Is It Mining". <br />The information you provided indicates mineral specimens will be extracted from the Bighorn <br />Spine Lode Claim, CMC# 287912, located in the San Isabel National Forest, Chaffee County. The <br />excavation activity will be conducted with hand tools; no explosives or heavy equipment will be <br />utilized. You have noticed the Bureau of Land Management and the South Platte Ranger <br />District (USFS) of your intent to conduct a mining operation. <br />The Colorado Mined Land Reclamation Board (Board) has requested the Division make <br />preliminary determinations regarding the need for a mined land reclamation permit. Based on <br />the information provided in your response, it is the Division's opinion the proposed project is a <br />mining operation. Pursuant to Colorado law, you are required to first obtain a mined land <br />reclamation permit from the Board prior to initiating the mining operation. If you disagree with <br />the Division's determination you may petition the Board for a declaratory order whereby you <br />may obtain an exemption from permit requirements. Such request must be made in writing <br />and must be received no later than ten days prior to a regularly scheduled Board meeting.
