Mr. Scott <br /> Response to Preliminary Review of a 112 Construction Materials Reclamation Permit Amendment <br /> Package, Derr Pit, Permit M2008-017 <br /> Page 6 <br /> Please provide evidence (certified letter to structure owners) that a notarized <br /> agreement between the structure owners and the applicant was pursued. If an <br /> agreement is unable to be reached a geotechnical assessment may be provided to <br /> demonstrate that the structures shall not be damaged. <br /> Response: <br /> 1. Damage waivers have been provided to all structure owners within 200 ft of the <br /> permit area. See the attached damage waiver agreements and certified mail <br /> receipts. A detailed listing of structures and owners has been included in Exhibit <br /> S. All structures/owners have been shown on the updated Exhibit C maps. See the <br /> attached updated Exhibit S. <br /> 2. A geotechnical slope stability analysis has been done to ensure that no structures <br /> will be adversely affected by the mining. See the slope stability report attached to <br /> the updated Exhibit S. <br /> Thank you for your consideration of the responses we are providing and the revised exhibits for <br /> the amendment request.
