6/11/2018 State.co.us Executive Branch Mail-Fwd:Sage Creek Coal Bond Release Application Question
constructed drainage in which these spoil springs appeared has had spoil springs within it at various areas in the past,
as can be the nature of spoil springs to express and dry up as flow paths change within a backfilled area.
As you know, we've in the past approved areas for Phase III bond release within which spoil springs existed. Given
what's going on with Sage Creek's CDPS permit, I was just wondering what if any concerns WQCD might have relative
to us proceeding with issuing a Proposed Decision to Approve the SL4 bond release request for the Sage Creek Mine.
Since Phase III bond release is the last phase of bond release (there is no Phase "IV"), we would be terminating our
jurisdiction over the area in the bond release request(we won't be terminating the DRMS permit for the Sage Creek
Mine because there are still other areas that need to be reclaimed and granted Phase III bond release).
While these springs are not specifically identified as outfalls on the Sage Creek CPDS permit, the springs nevertheless
report to Sage Creek's Pond 002.
Dan
Daniell.
