In the "compliant" it is stated that "Terror Creek has locked you out of your right of way to <br />the road for access to build three houses" and you "are looking to develop your land and you <br />need the gate removed or moved to the bottom of the hill on the property line." A copy of a <br />warranty deed was attached in the email to the Division. <br />As you are aware, a similar objection was brought forth to the Division during the Permit <br />Renewal No. 6 application for the Terror Creek Loadout in a letter dated February 26, 2013. <br />That objection stated that the gate is maintained in a closed and locked position, preventing <br />lawful access to the easement. In a Finding by the Division for the Permit Renewal Application <br />No. 6, the Division found that it is without authority to adjudicate the dispute or consider the <br />unresolved dispute as a deficiency that would warrant denial of the Permit Renewal application <br />No. 6. This Finding is applicable in addressing your "complaint" to the Permit Renewal No. 7 <br />application. <br />I have attached a copy of the Division's Findings document pages 5 and 6 associated with the <br />Permit Renewal No. 6 Decision to the previous objection. <br />The Division appreciates your comments and concerns.
