Deep Cut LLC - 22 West Pit Page 19
Adequacy response 01 Permit # M-2017-032
Colorado Parks and Wildlife
I contacted the Pueblo regional office of CPW and spoke to Ed Schmal, CPW Biologist who deals
with Raptors for the Southeast-Region to find out if there were any raptor nests in the vicinity of
the mine. He said that according to their data base there were none within one mile of the permit
area. He recommended I contact the local Division Office in Lamar to see if they had more local
up to date information. Officer Jordon De Priest who patrols the Rocky Ford area indicated there
were no know Raptor nests, resting area or hunting areas within one mine of the mine area. Both
Officers Schmal & De Priest explained that all the CPW was asking for in their recommendation
was that observations be made by the operator to identify and locate active nests, nightly roosts,
and active hunting areas that may exist in the area to be mined and take the appropriate actions to
prevent their disturbance. They also said that someone from CPW can be contacted if a raptor
site is observed to get their opinion on the impact the mine may have on it.
I have revised page 24(revised 4/30/18)to include a discussion on how Deep Cut LLC will deal with
potential raptor impacts in the future. Deep Cut is committing to contacting CPW for help
mitigating or eliminating impact to the operation, should raptors be observed in the proximity of the
active mining operations.
I hope these responses have addressed the adequacy questions you
had. I have included a set of pages showing the revisions to the
original plans . The green highlighted areas are where the text was
revised. I will place a copy of this packet with the Otero County
Clerk' s office as required and proved proof of placement .
