• Wetlands and Riparian <br /> • Wildlife Aquatic <br /> • Wildlife Terrestrial <br /> • Migratory Birds <br /> • Visual Resources <br /> 3.2 PHYSICAL RESOURCES <br /> 3.2.2 GEOLOGIC AND MINERAL RESOURCES <br /> Affected Environment: <br /> The proposed action is located within the same small-scale bench placer deposits as the <br /> existing operation. This deposit consists of sand,gravel and cobbles that have been deposited by <br /> the river over time. <br /> The operator is proposing to stage a temporary, weather resistant, steel locker(tool chest) <br /> that will not be larger than 4' x 4' x 8' to store equipment securely on site. It is proposed that the <br /> locker would be located on the western edge of the proposed work area at the base of the hill. <br /> The locker will stay onsite for the remaining life of the mine and will be removed during final <br /> reclamation. It will also be secured with a heavy duty lock. <br /> In addition,the tractor or backhoe may be left on site overnight while in use,but will be <br /> removed from the site during times of nonuse. <br /> Environmental Effects <br /> Proposed Action <br /> Direct and Indirect Impacts: The proposed action includes the staging of a locker and <br /> mine equipment,which may constitute occupancy under the Mining Law of 1872, as defined under <br /> 43 CFR 3715.0-5. <br /> Per 43 CFR 3715.0-5, Occupancy means full or part-time residence on the public lands. It <br /> also means activities that involve residence; the construction,presence, or maintenance of temporary <br /> or permanent structures that may be used for such purposes; or the use of a watchman or caretaker <br /> for the purpose of monitoring activities.Residence or structures include,but are not limited to, <br /> barriers to access,fences,tents,motor homes,trailers,cabins,houses,buildings, and storage of <br /> equipment or supplies. <br /> Per 43 CFR 3715.2, activities that are the reason for an operator's occupancy must: <br /> 1. Be reasonably incident; <br /> 2. Constitute substantially regular work; <br /> 3. Be reasonably calculated to lead to the extraction and beneficiation of minerals; <br /> 4. Involve observable on-the-ground activity that BLM may verify under § 3715.7; and <br /> 5. Use appropriate equipment that is presently operable, subject to the need for <br /> reasonable assembly,maintenance,repair or fabrication of replacement parts. <br /> Per 43 CFR 3715.2-1, in addition to the requirements specified in part 3715.2,the occupancy <br /> must involve one or more of the following: <br />
