O. Box 1430 <br />Palisade CO 81526 <br />Dear People: <br />CIVIL ENGINEERING <br />CONST. MANAGEMENT <br />Snowcap Coal Company, Inc. (SCC) is responsible for the reclamation of the Roadside South <br />Portal Mine under Division of Reclamation, Mining and Safety (DRMS), Permit No. C-1981-041. <br />The operator ceased mining in December, 1999. <br />One provision of the DRMS' Rules is that the mine be bonded for the estimated reclamation cost. <br />SCC will formally request a bond release from the DRMS asking that approximately 10.4 acres of <br />reclaimed surface lands and 291.3 acres of undisturbed surface lands be completely released <br />from the bond. A surety bond in the amount of $65,702.24 is currently in place, of which <br />approximately $14,444 will be requested for release. In accordance with the Division's Rule <br />3.03.2(1), SCC is required to send written notice of its intention to seek release from bond to <br />adjacent land owners, surface owners and various local governing bodies. <br />The bond release will be requested for the Roadside South Portal Mine located approximately <br />three miles northeast of Palisade, CO at the Interstate 70, Cameo Exit No. 46. The areas in <br />which SCC's requesting bond release are Substations A & B, a portion of the North Decline, a <br />portion of the Roadside Borrow Area, a portion of the Conveyor Corridor and the remainder or <br />Light Use Road #1. Portions of the areas requested for release have been undermined. The <br />area locations are more particularly described as follows: <br />Township 10 South, Range 98 West, 6th P.M., Mesa County, CO <br />Portions of Sections 26, 34 and 35 <br />Township 11 South, Range 98 West, 6t" P.M., Mesa County, CO <br />Portions of Section 2 <br />All work has been performed in accordance with plans approved by the DRMS. <br />Sincerely, <br />Tonya K.
