Rtidibattgh Pit, Permit No. M-1995-057, Reason to Believe Violations Evist and Notice of Board <br />Hearing <br />Mrs. Rudibaugh: <br />On March 14, 2018 the Division of Reclamation, Mining and Safety (Division) conducted an inspection <br />of the above referenced operation (see attached inspection report) and found the following: <br />The financial warranty is not adequate to reclaim the site in accordance with the approved <br />reclamation plan, <br />Trash and refuse was noticed on the site. The south portion of the permit area is being used as a <br />junkyard, and <br />The mine identification sign posted at the entrance to the site is dilapidated and the required <br />information is not legible. <br />Based on the findings of the inspection we believe these are in violation of: <br />• C.R.S. 34-32.5-117(4) (c)(11): A financial warrantor shall have sixty days after date of notice of <br />an adjustment to fulfill the new requirements. <br />• C.R.S. 34-32.5-116(4)(e): all refuse shall be disposed of in a manner that controls unsightliness or <br />deleterious effects of such refuse. <br />• Rule 3.1.12 (1): At the entrance to the mine site an operator shall post a sign, which shall be <br />clearly visible from the access road. <br />Therefore, the Division has reason to believe that a violations exist to the Mined Land Reclamation Act, <br />C.R.S. 34-32.5-101 et sem., and have scheduled this matter to appear before the Mined Land Reclamation <br />Board (Board). <br />A Formal Public Hearing will be held during the June 27-28, 2018 Board meeting for consideration of <br />these possible violations. The hearing will be held at 1313 Sherman Street, Room 318, Denver, Colorado, <br />beginning at 9:00 a.m. on June 27, 2018 or as soon thereafter as the matter can be considered.
