Louisville will deliver fully consumable water to Coal Creek a tributary to Boulder Creek, at <br />Louisville’s discharge point (WDID 0602301) on Coal Creek located in the NW1/4 of the SE1/4 of <br />Section 9, Township 1 South, Range 69 West of the 6th P.M. A 15 percent transit loss will be applied <br />to all deliveries as specified in your Table AI.3. <br /> <br />Conditions of Approval <br /> <br />I hereby approve the proposed SWSP in accordance with § 37-90-137(11), C.R.S. subject to <br />the following conditions: <br /> <br />1. This SWSP is approved with the effective date of May 23, 2018 and shall be valid through <br />October 31, 2018 unless otherwise revoked or superseded by a decree. This plan will be <br />extended until December 31, 2019, if the applicant submits a lease from the City of Louisville <br />for the period of November 1, 2018 through December 31, 2019 prior to October 31, 2018 that is <br />adequate to replace the depletions at this site. If this plan is not decreed in water court by the <br />SWSP expiration date, a renewal request must be submitted to this office with the statutory fee <br />of $257 no later than September 1, 2018 or November 1, 2019 if extended. If a renewal <br />request is received after the expiration date of this plan, it will be considered a request for a <br />new SWSP and the $1,593 filing fee will apply. <br />2. A well permit must be issued for the gravel pit in accordance with Section § 37-90-137(2) and (11), <br />C.R.S. since the exiting well permit no. 64830-F was approved for an exposed surface area of 0.86 <br />acres. Well permit application (receipt no. 3686237) was submitted for this site on May 8, 2018 and <br />this application is pending evaluation. The provisions of § 37-90-137(2), C.R.S. prohibits the <br />issuance of a permit for a well to be located within 600 feet of any existing well, unless the State <br />Engineer finds that circumstances so warrant after a hearing held in accordance with the <br />procedural rules in 2CCR402-5. This hearing may be waived if you are able to obtain statements <br />from the owners of all wells within 600 feet, verifying that they have no objection to your use of <br />the proposed well. Should a new well permit be denied for reasons of 600 foot spacing, or any <br />other legitimate reason, approval of this SWSP will be cancelled. <br />3. The total surface area of the groundwater exposed at the Turnpike Mining Resources site must <br />not exceed the acreage identified in Table 1. <br />4. The annual water used for dust control at the Turnpike Mining Resources site shall not exceed <br />2.49 acre-feet/year, the total product mined at the Turnpike Mining Resources site shall not <br />exceed 150,000 tons per year, which results in 4.43 acre-feet/year of water lost with the mined <br />aggregate. <br />5. Total consumption at the Turnpike Mining Resources site must not exceed these aforementioned <br />amounts unless an amendment is made to this SWSP. <br />6. Approval of this SWSP is for the purposes as stated herein. This office must first approve any <br />additional uses for the water. Any future additional historical consumptive use credit given <br />(e.g., agricultural water transfer) for this site must consider all previous credits given. <br />7. All pumping for dust control shall be measured in a manner acceptable to the division engineer. <br />8. The Applicant shall install and maintain measuring devices as required by the division <br />engineer for operation of this SWSP. The totalizing flow meter must be installed and <br />maintained in accordance with the Division One Ground Water Measurement Rules decreed
