(“Asphalt Specialties “ or “Applicant”) in accordance with § <br />37-90-137(11), C.R.S. The Applicant shall be responsible for compliance with this SWSP, but the State <br />Engineer’s Office may also pursue the landowner, for eventual compliance. The required fee of <br />$1,593 for the SWSP has been paid (receipt no. 3685544). <br />SWSP Operations <br />This plan seeks to replace depletions resulting from mining at the Turnpike Mining Resource <br />Gravel Pit (“Turnpike Pit”). The last SWSP for this site was approved in 2006 and expired July 31, <br />2008. The Applicant claims that replacement water from the City of Louisville has been <br />continuously delivered to Boulder Creek since 2008. However no evidence was provided to support <br />such claim. In addition, accounting for the depletions and replacement associated with the mining <br />operation at the site has not been provided. Therefore, for the purpose of this SWSP Asphalt <br />Specialties must comply with the requirement of Condition No. 10 of this SWSP. <br />
