(“Asphalt Specialties “ or “Applicant”) in accordance with §
37-90-137(11), C.R.S. The Applicant shall be responsible for compliance with this SWSP, but the State
Engineer’s Office may also pursue the landowner, for eventual compliance. The required fee of
$1,593 for the SWSP has been paid (receipt no. 3685544).
SWSP Operations
This plan seeks to replace depletions resulting from mining at the Turnpike Mining Resource
Gravel Pit (“Turnpike Pit”). The last SWSP for this site was approved in 2006 and expired July 31,
2008. The Applicant claims that replacement water from the City of Louisville has been
continuously delivered to Boulder Creek since 2008. However no evidence was provided to support
such claim. In addition, accounting for the depletions and replacement associated with the mining
operation at the site has not been provided. Therefore, for the purpose of this SWSP Asphalt
Specialties must comply with the requirement of Condition No. 10 of this SWSP.
