The contaminated <br />emulsion and soil was placed <br />in the active pit of N9 ramp <br />24. No hazardous chemical <br />waste will be disposed of <br />within the permit area in <br />accordance with Volume <br />Chapter 6 -Solid Waste <br />Disposal of the Kayenta Mine <br />Permit. All hazardous <br />material will be disposed off- <br />site in accordance with the <br />applicable Federal and State <br />regulations. The emulsion is <br />listed as hazardous material <br />defined by the EPA -TSCA <br />1. Temporary storage of <br />noncoal waste 2. Failure to <br />maintain sediment pond. 3. <br />Inaccurate reporting of <br />sediment pond conditions 4. <br />Failure to maintain <br />downdrains 5 Improper <br />storage of refuse. <br />Part 1 of 2: PWCC has failed <br />to ensure 1) sediment <br />pond/impoundments have <br />been constructed and/or <br />maintained as designed 2) <br />accurate information has <br />been provided to the <br />regulatory authority regarding <br />certifications that <br />impoundments have been <br />constructed and/or <br />maintained as designed. <br />Part 2 of 2. Failure to ensure <br />sediment control measures <br />have been designed, <br />constructed and maintained <br />to minimize erosion <br />Properly dispose of <br />hazardous material off- <br />site in accordance with <br />the applicable Federal <br />and State regulations. <br />Modification <br />(11/15/2016): In order to <br />abate the violation, <br />Peabody may either (1) <br />treat the material as <br />hazardous waste and <br />dispose of it in <br />accordance with <br />applicable Federal and <br />State regulations; or (2) <br />provide written <br />concurrence from the <br />USEPA that the material <br />is non -hazardous solid <br />waste and either. <br />properly dispose of it or <br />submit a revised disposal <br />plan for approval. <br />1.
