EXHIBIT S - PERMANENT MAN-MADE STRUCTURES <br /> The information provided in this Exhibit is intended to satisfy the requirements outlined in Section <br /> 6.4.19 of the Colorado Mined Land Reclamation Board Construction Material Rules and <br /> Regulations. <br /> Where mining will adversely affect the stability of any significant, valuable or permanent <br /> man-made structure located within 200 feet of affected land, the applicant may either. <br /> a) Provide a notarized agreement between the applicant and the person(s)having <br /> an interest in the structure, that the applicant is to provide compensation for any <br /> damage to the structure,or <br /> b) The applicant shall provide an appropriate engineering evaluation that <br /> demonstrates that such structure shall not be damaged by activities occurring <br /> at the mining operation:or <br /> c) Where the structure is a utility, the Applicant may supply a notarized letter stating <br /> that the mining and reclamation as proposed will have no negative effect on their <br /> utility. <br /> The known, permanent, man-made structures within 200 feet of the proposed mine areas <br /> are listed as follows: <br /> o Mcglothlin, residence building <br /> o Green Valley Turf, residence building <br /> o Fleming, James, storage buildings <br /> o CDOT, Storage&Garage buildings <br /> o Various buildings owned by land owner <br /> o Oil &Gas Facilities surrounding the site (Anadarko) <br /> o WCR 25.5 &ROW(Weld County Public Works) <br /> o Highway 85(CDOT) <br /> o Rail Road (Union Pacific) <br /> o Suncor Gas Line <br /> o Private Irrigation Appurtenances (owned by land owner) <br /> o Overhead Power Line (North, South, East&West Boundary)(XCEL) <br /> o Power Line (Private) <br /> o 34-6 Well Head (Kerr-McGee/Anadarko) <br /> o 23-6 Well Head (Kerr-McGee/Anadarko) <br /> o 33-6A Well Head (Kerr-McGee/Anadarko) <br /> o 25-6 Well Head (Kerr-McGee/Anadarko) <br /> o 24-6(DIR)Well Head (Kerr-McGee/Anadarko) <br /> o 43-6(DIR) Well Head (Kerr-McGee/Anadarko) <br /> o Telephone, west, south and by Hwy 85 (Century Link) <br /> o Telephone/Fiber by Rail Road ROW, east side (Level 3 <br /> Communications) <br /> Hunt Water, LLC-Gravel Mine-MLRB 112 Permit Application <br /> Exhibit S-1 <br />
