Trujillo RECEIVED <br />Environmental Protection Specialist MAY 18 2018 MAY 15 2018 <br />Colorado Division of Reclamation, Mining and Safetv <br />1313 Sherman St., Room 215 <br />Denver, CO 80203 Division of Reclamation. <br />Mining & Safety <br />Re: Colowyo Coal Mine (Permit No. C-1981-018) Technical Revision No. 120 (TR -120) Collum Pond As - Built (SHPO <br />Project #67752) <br />Dear Mr. Trujillo: <br />Thank you for your correspondence dated April 27, 2018 (Received by our office on Mav 3, 2018) for the above referenced project <br />submitted to our office is pursuant to the Section 106 of the National Historic Pre,er<-ation Act and 36 CFR 800. <br />As the above referenced permit revision does not propose additional surface disturbance outside of the currently approved area for <br />disturbance, it is our opinion that a finding of no historic properties affectedis appropriate for the proposed undertaking <br />pursuant to 36 CFR 800.4(d)(1). <br />Should human remains also be discovered during project activities, the requirements under State law C.R.S. 24-80 (part 13) apply <br />and must be followed. <br />We request being involved in the consultation process with the local government, which as stipulated in 36 CFR 800.3 as <br />required to be notified of the undertaking, and with other consulting parties. .Additional information provided by the local <br />government or consulting parties nught cause our office to re-evaluate our ehgibility and potential effect findings. Please note <br />that our compliance letter does not end the 30 -day review period provided to other consulting parties. <br />Thank you for the opportunity to comment.
