Box 628 <br />Nucla, CO 81424 <br />Dear Mr. Wolney, <br />Per our discussion in regards to retaining the New Horizon haul road as a permanent feature in <br />accordance with Rule 1.04(71), this letter is to serve as formal notification that as the surface <br />landowner, I would like the haul road to remain as a permanent feature on my property. <br />Rule 1.04(71) states, "...AII of the land uses defined below may include land used for support facilities <br />which are adjacent to, or are an integral part of the land..." Retention of the haul road on my property <br />will be utilized as a support facility directly adjacent to long term reclamation areas so that my land can <br />be property accessed by using the haul road.
