1993 and available maps to account for the acres. A review of the data shows that over the NH Mine's 30 <br />year history, numerous errors in accounting, mapping and reporting were made. The Division worked <br />with ERMR using the historic data and modern mapping data to determine the correct values for the bond <br />released acres. The total corrected values for bond released acres, including the acres approved for release <br />in SL -19, are: Phase 1— 872.8, Phase II — 645.05 and Phase III — 481.92. <br />VI. Proposed Decision <br />Based on the review process outlined in detail above, the Division proposes to approve ERMR's request <br />for a partial Phase II release of 23.7 acres and partial Phase III bond release on 272.0 acres at the New <br />Horizon Mine. The 23.7 acres being requested for Phase II release are within the 272.0 acres being <br />requested for Phase III. This proposed decision will release the applicant from liability for all reclamation <br />work on the areas depicted on Map 1 (received February 1, 2018) of the SL -19 application (see Appendix <br />A) <br />The Division proposes to approve SL -19 with the initial reclamation cost estimate of $4,581,549.47. As <br />a result of the work accomplished for SL -19, the reclamation cost estimate is proposed to be reduced by <br />$611,158.70 for a remaining liability of $3,970,390.77. <br />The Division presently holds a self -bond in the amount of $5,300,000 for the New Horizon Mine. The <br />Division proposes to release $611,158.70 through approval of SL -19. The remaining $3,652,640.69 bond <br />will be sufficient to assure completion of the remaining reclamation work at the site if the work had to be <br />performed by the Division. This bond amount includes the cost of reestablishing vegetation on any <br />revegetated areas, should those areas fail (Rule 3.03.1(3)(a) and 3.01.3(3)(d)). <br />Any person with a valid legal interest which might be adversely affected by this proposed decision may <br />request a formal public hearing before the Mined Land Reclamation Board in accordance with Rule <br />3.03.2(6). Public notice of this proposed decision will be published twice in the San Miguel Basin Forum <br />as soon as possible. Requests for public hearing must be submitted to the Division in writing within thirty <br />(30) days of the first publication in the San Miguel Basin Forum.
