PERMIT #: M2018-023 <br />INSPECTOR'S INITIALS: ECS <br />INSPECTION DATE: May 1, 2018 <br />OBSERVATIONS <br />This was an inspection conducted by Eric Scott of DRMS. The inspection was triggered by a complaint <br />submitted by Weld County Planning for property located on the southeast corner of Weld County Road 4 and <br />Weld County Road 39. The complaint was submitted against excavation activity taking place on the two <br />parcels that make up that area (see attached map). One parcel, address 19452 WCR4, is owned by TRS <br />Equities LLC and the other, address 348 WCR 39, is owned by Highland Equities LLC. The mailing address is the <br />same for both entities, 8301 E Prentice Ave Ste 100, Greenwood Village CO 80111-2904, and the contact <br />person listed for both properties is Robert Lembke. <br />When DRMS arrived at the site there was no excavation taking place although there was heavy equipment <br />present (two scrapers), evidence of recent excavation, and a shallow trenched area. One of the equipment <br />operators stated that that area was providing borrow material to be used on a nearby warehouse construction <br />site. They further stated that the site is located to the south, on the east side of Interstate 76 just over the <br />county line into Adams County, and that the construction supervisors were located in an on-site trailer at that <br />location. <br />DRMS proceeded to the construction site as described and met with representatives of Mortenson <br />construction. The Mortenson representatives described the activity taking place, and provided <br />documentation (Weld County Grading Permit GRD18-0009) for the excavation work that was being conducted <br />at the location described above. They also stated that they had been issued CDPHE air quality and storm <br />water control permits as well for the work at both sites. <br />Due to the Weld County permitting already in place, at this time, DRMS will not consider this activity to <br />constitute mining without a permit. However, DRMS would like to inform all parties involved with this project <br />that effective July 2018, a new DRMS permit classification, 111(ib), will Po into effect. This new permit <br />classification is intended to apply to "one time" construction activity (such as this) and it is very likely that this <br />type of activity would require a DRMS permit that time if the work has not been completed or is expanded <br />beyond its current scope. <br />Page 2 of 3 <br />
