Page 3 <br />Second, with the liquidation of Energy Fuels Coal, Inc., the permittee for C-1981-014 no longer <br />exists. As such, a willful failure of compliance with the Act, the Rules, or the conditions of the <br />permit satisfies the willful requirement of the second prong. <br />The Division, therefore, recommends that you issue an order to show cause as to why permit C- <br />1981-014 for the Southfield Mine should not be suspended or revoked to Energy Fuels Coal, <br />Inc., no later than May 11, 2018. A completed form for your signature is attached. See <br />Attachment 2. The issuance of a Show Cause Order to EFC is not demonstrably unjust in that <br />EFC has been liquidated and has effectively abandoned its obligations under the Act, the Rules, <br />and its permit. <br />Attachment: Show Cause Order <br />
