PEABODY SAGE CREEK MINING, LLC SAGE CREEK MINE - PERMIT C-2009-087 MID-TERM ADEQUACY RESPONSES (04/18) Item 1: Table Updates Please update the Peabody Energy Corporation: NOV report (Exhibit 2.03.5 -EI) to include the WQCD NOT as listed in the updated pages provided with RNI in Section 2.03.5. Please update Tables 2.04.7 T-9 through T-12 to represent any updates to the Monitoring Plan, including a reference to the new nomenclature of the NPDES points. Response: Exhibit 2.03.5-E1 has been reviewed and updated to reflect any recent NOV's, consistent with the applicable regulatory requirements, specifically including the referenced WQCD NOV. Copies of the updated permit documentation accompany these responses for replacement in the PAP. Tables 2.04.7 T-9 through T-12 have been reviewed and updated to include any updates or modifications to monitoring plans, and to reflect the WQCD re -designation of discharge monitoring points. Copies of the updated permit documentation accompany these responses for replacement in the PAP. Item 2: NPDES Permit Exhibit 2.05.3-E3, CDPHE Water Discharge Permit, includes a permit which expired December 31, 2012. As of August 2016, pg. 2.03-21 of the Permit references the NPDES permit as "Expires: Reapplication Pending". DRMS understands that this permit is still in the appeals process, but DRMS requests that this be updated with an explanation of the discharge permit status, and that a copy of the draft permit that Sage Creek Mine is currently working under, be added to the DRMS permit for reference and clarity. Response: The referenced Exhibit and related text have been reviewed and updated to explain the CDPS permit renewal process and status. A copy of the final issued permit is provided for reference and context. Copies of the updated permit documentation accompany these responses for replacement in the PAP. Item 3: CDPHE Air Permit Permit Section 2.05.3 (pg. 2.05-63) describes the Air Pollution Control Plan in effect at the Sage Creek Mine as meeting the requirements of Rule 2.05.6(1). DRMS was unable to locate a current copy of the approved air emissions permit fr-oni the Colorado Department of Public Health and Environment — Air Pollution Control Division. Please update this section as needed and provide a current Air Emissions Permit. Response: A Construction Permit (Permit l OROI 175F) was issued by APCD on 09/04/12. PSCM filed Notification of Start-up for AIR'S Points 001 (01/16/13), and 002, 004, and 006 (08/16/12 - in anticipation of Permit issuance) under this Permit. Most site development activities were idled about the time the Permit was issued, and a Notice to Set Emissions to Zero was submitted (10/12/12) for AIR'S
