Indicate whether this documentation is to: <br />• invite the ACHP to participate in a Section 106 consultation, and/or <br />Pursuant to 36 CFR 800.13(b)(3) Post -review discoveries if the agency official has approved the <br />undertaking and construction has commenced <br />II. Information on the Undertaking* <br />6. Describe the undertaking and nature of federal involvement (if multiple federal agencies are <br />involved, specify involvement of each): <br />hi 2016, the Office of Surface Mining Reclamation and Enforcement recommended approval for the <br />Assistant Secretary of the Interior for Lands and Minerals of the Mining Plan Decision Document for <br />the Colowyo Mine, Collom Expansion. The Collom Expansion included plans for a new coal haul <br />road. The Assistant Secretary approved the project in 2016. <br />The mine operator, Tri-State, has begun clearing topsoil for the surface mine pit and haulted work in a 30 <br />meter radius around a scattered group of artifacts. The work stoppage is affecting their timeline <br />currently. Tri-State notified the Colorado Division of Reclamation Mining and Safety, as well as the <br />Office of Surface Mining Reclamation and Enforcement on April 19, 2018. <br />7. Describe the Area of Potential Effects: <br />The "isolated find," group of historic artifact debris is within the area to be cleared and mined. For a <br />surface coal mine, a mining area is identified. The initial work is the clearing and stockpiling of <br />topsoil for later reclamation. Then after topsoil is cleared and stored, the operator removed the <br />overburden (non -coal earth) to get to the coal seams. The coal is then removed and the overburden <br />replaced. Finally, the topsoil is replaced. This is an oversimplification, but an accurate representation <br />for purposes of this isolated find.
