This letter was to <br /> inform the Permittee that CDPHE believed that a discharge or potential to discharge existed at <br /> the Fairplay Au Pit and advised the Permittee to secure a stormwater discharge permit for the <br /> site. High Speed Mining, principally interested in being compliant with all state, local, and <br /> federal laws and regulations that applied to the Fairplay Au Pit, submitted a stormwater <br /> discharge permit application that accurately noted that the site would never discharge water. This <br /> is due, as DRMS knows,to the layout of the site: all disturbed areas of the mine drain to the <br /> mining pit(s)where said stormwater evaporates. <br /> CDPHE responded in February 2018 with a request for more information in order to process the <br /> discharge permit application. CDPHE maintained that the road used to access the river, which is <br /> unrelated to the mining operation, could have stormwater flow from it offsite,thus being a <br /> discharge. High Speed Mining therefore modified its operating plans at the Fairplay Au Pit to <br /> include a small sump at the base of this river access road. This way no runoff from the road <br /> leaves the site, and there is no discharge. In light of this,the stormwater discharge permit <br /> application was withdrawn on March 28, 2018. <br /> This technical revision is to incorporate the river access road sump into the approved DRMS <br /> permit. <br /> Fairplay Au TR 1 <br />
