<br /> Consistent with the Water Quality Permits Policy 1 (WQP-1, Permit Inactivation Policy Where A Discharge Remains),
<br /> a permit can be inactivated, or outfalls removed from the permit, when a discharge remains only if the following
<br /> conditions are met:
<br /> 1. the permittee can demonstrate that, without treatment (including settling ponds), the water quality
<br /> standards/ beneficial uses of the receiving stream are not violated by the continuing discharge; and
<br /> 2. all activity at the site has ceased; and
<br /> 3. the Division has visited the site and concurs with the inactivation.
<br /> WQP-1 requires the permittee to supply one year of water quality data, collected at least monthly and prior to any
<br /> treatment, for each outfall. Consistent with WQP-1, the parameters analyzed are those that will enable the
<br /> Division to determine that the continuing discharge will not exceed the water quality standards for the receiving
<br /> water body. The permittee must conduct all monitoring consistent with the permit.
