Hoshiko Land, LLC <br /> Post Office Box 119 <br /> Kersey, Colorado 80644 <br /> Phone:(970)330-8780 <br /> RECEIVEe <br /> April 16,2017 v APR 16 Z01$ <br /> D(ftON OF RFC <br /> Division of Reclamation, Mining and Safety MININO,gNO��TIOI y <br /> 1313 Sherman Street,Room 215 <br /> Denver, Colorado 80203 <br /> Re: Protest of, and opposition to the approval of Regular(112) Construction Materials <br /> Operation Reclamation Permit <br /> To Whom It May Concern, <br /> This letter serves as written documentation of the protest of Hoshiko Land, LLC ("Hoshiko"), a <br /> Colorado Limited Liability Company, and its opposition to the approval of the application for a <br /> Regular(112) Construction Materials Operation Reclamation Permit filed by Broken Arrow <br /> Investments, LLC (`Broken Arrow") in conjunction with the proposed mine known as the Derr <br /> Pit, located at or near Section 4, Township 5 North, Range 65 West of the Oh Principle Meridian, <br /> Weld County, Colorado due to its close proximity to Hoshiko's irrigation well identified as Well <br /> Permit No. 12332-R in the records of the Colorado Division of Water Resources. <br /> Other recent mining operations conducted by Broken Arrow and its predecessors in the <br /> immediate vicinity have continuously exposed considerable amounts of groundwater which has <br /> dewatered the Hoshiko well beginning in 2014 and rendered it inoperable since then. Further <br /> mining proposed by Broken Arrow in this area will cause the Hoshiko well to continue to be <br /> dewatered and inoperable for an unacceptably longer period of time.
