V. EQUAL SERVICE OPPORTUNITY <br /> This permittee is an equal opportunity service provider. The receipt of a Forest Service Special <br /> Use Permit is considered to be receipt of Federal Financial assistance under Federal <br /> regulations. This permittee, as a recipient of Federal financial assistance, must meet the <br /> requirements of all laws, regulations, and USDA policies regarding nondiscrimination in the <br /> provision of services to the public. The following program has been implemented to meet these <br /> requirements: <br /> A. Employee Policies: (Describe how employees are made aware of nondiscrimination policies, <br /> describe diversity of employees, etc.) <br /> Currently Lost Creek Mining, LLC consists of only the owners/partners Ian Schimpfle and Jason <br /> Roys. If and when we hire employees, we will make all employees aware of nondiscrimination <br /> policies in any and all ways that are allowable and applicable to state and federal law. Since we <br /> do not currently have a retail location, and our work areas are most often outdoors, new hires <br /> will be informed of Title VI Civil Rights Act requirements by the same method that we (Mr. <br /> Schimpfle and Mr. Roys) have just done, by reviewing the law online at the OASAM website: <br /> hftps://www.dol.gov/oasam/reas/statutes/titievi.htm <br /> B. Complaint Policy: (Describe how participants are made aware of complaint procedures, how <br /> you handle complaints, number of complaints received, basis for complaints, etc.) <br /> Students will be made aware of how to contact us regarding any complaints of discrimination, <br /> on the Student Agreement/Waiver and Release of Liability form that all students will be required <br /> to sign and remit to Lost Creek Mining, LLC. Complaints will be resolved internally and directly <br /> with the involved parties if possible and prudent. If it is prudent, outside legal assistance or <br /> arbitration will be implemented. <br /> C. Participation: (Describe specialized equipment or services and programs provided to <br /> accommodate disabled person, minorities, etc. to demonstrate diversity of use.) <br /> While we would love to share our passions for the outdoors and prospecting to disabled <br /> persons, we cannot feasibly utilize any specialized equipment to assist disabled persons to the <br /> class site. The physically demanding nature of the excursion will be expressed to all interested <br /> parties. Any interested party who meets the requirements of proper clothing, footwear, and <br /> physical condition as set forth in the Student Agreement/Waiver and Release of Liability, will be <br /> allowed to take the class, and whom we will assist in any way we can. <br /> D. Self-Evaluation: (Describe your program of self-evaluation to ensure nondiscrimination <br /> requirements are being met.) <br /> As only the two partners/owners are currently involved in these operations, the two will <br /> constantly evaluate each other to ensure nondiscrimination requirements are being met. <br /> VI. RESOURCE PROTECTION <br /> Permittee will ensure that all staff have a working knowledge of low-impact techniques, practice <br /> them at all times on National Forest lands, and educate clients to those principles.
