PERMITTED EXCEPTIONS
<br /> 1. Rights or claims of parties in possession not shown by the public records.
<br /> 2. Easements,or claims of easements, not shown by the public records.
<br /> 3. Discrepancies,conflicts in boundary lines,shortage in area,
<br /> encroachments, and any facts, which a correct survey and inspection of the
<br /> premises would disclose,and which are not shown by the public records.
<br /> 4. Taxes and assessments for 2007 and subsequent years, a lien not yet due
<br /> or payable.
<br /> 5. Any and all water rights, claims, or title to water,whether or not the
<br /> matters excepted are shown by the public record.
<br /> 6. Right of way for ditches or canals constructed by the authority of the
<br /> United States, as reserved in United States Patent recorded January 16,
<br /> 1925 in Book 112 at Page 424 and reservation of all oil and gas,together

<br /> Patent, and any and all interests therein or assignments thereof.
<br /> 8. Right of way for ditches or canals constructed by the authority of the
<br /> United States, as reserved in United States Patent recorded January 28,
<br /> 1943 in Book 208 at Page 138 and reservation of all coal and other
<br /> minerals, together with the right to prospect for,mine and remove the
<br /> same pursuant to the provisions and limitations of the Act of December
<br /> 29, 1916 in said Patent, and any and all interests therein or assignments
<br /> thereof.
<br /> 9. Reservations,conditions and stipulations contained in the United States
<br /> Patent No. 1431391 recorded April 10, 1951 in Book 257 at Page 543
<br /> including,but not limited to the following:
<br /> • That the grant hereby made is restricted in its exterior limits to the
<br /> boundaries of the said mining premises, and to any veins or lodes
<br /> of quartz or other rock in place bearing gold, silver,cinnabar,lead,
<br /> tin,copper and other valuable deposits which may have been
<br /> discovered within said limits subsequent to and which were not
<br /> known to exist on July 12, 1949.
<br /> • That should any vein or lode of quartz or other rock in place
<br /> bearing gold,silver, cinnabar, lead, tin, copper or other valuable
<br /> deposits,be claimed or known to exist within the above-described
<br /> premises at said last-named dated,the same is expressly excepted
<br /> and excluded from these presents.
<br /> • Right of way for ditches or canals constructed by the authority of
<br /> the United States.
