6.4.4 Exhibit D-Mining Plan
6. The total Approximate Minable Acres provided by the Applicant on Table I in Exhibit D-
Mining Plan indicates the Total Approximate Mineable Acres is 159.88. On Page 1, Item
U.1 —Change in acreage on the Conversion Application Form, the Applicant proposes
adding 157.9 acres to the existing 9.9 permitted acres. Please explain the acreage
discrepancy between Table I and the conversion application form. Please revise the
conversion application as required to resolve the discrepancy.
Response:
We have corrected Table I. We have reduced Phase C mineable acres slightly to ensure we
are within the lease agreement of 167.5 acres. We have revised all documents to reflect the
correct total acres, 167.5. Total of the all Phases equals 158.54 acres which includes
mining through the original 1 IOc permit access road. The 158.54 includes the 0.94-acre
access road. The 110-mining area equals 8.96 acres. The actual acres added are 157.6.
However the total for all Phases is 158.54 which include the acres for the original access
road. (8.96+ .94+ 157.6= 167.5 acres.)
7. The Total Acres value provided by the Applicant on Table I in Exhibit D-Mining Plan
indicates the Total Acres at 167.5. On Page 1, Item #3-Permitted acreage (new and
existing site) on the Conversion Application Form, the Applicant proposes adding 157.9
acres to the existing 9.9 permitted acres for
167.8 total acreage in the conversion permit area. Please explain the total acreage
discrepancy between Table I and the conversion application form. Please revise the
conversion application as required to resolve the discrepancy.
Response:
Table one,Phase C has been corrected down to 16.44 acres. In addition,the Mine Plan
and Reclamation Plan maps and application form have also been revised to reflect the
acreage reduction. These changes,taking into account the access road, should correct
the discrepancy. Acreage totals on the application form and throughout the Conversion
Application now match.

8. The legal description provided by the Applicant on the Exhibit F-Reclamation Plan Map
states the proposed conversion permit area boundary is 167.5 acres. On Page 1, Item #3 -
Permitted acreage (new and existing site)on the Conversion Application Form, the
Applicant proposes adding 157.9 acres to the existing 9.9 permitted acres for 167.8 total
acreage in the conversion permit area. Please explain the total acreage discrepancy
between the map and the conversion application form. Please revise the conversion
application as required to resolve the discrepancy
